Fast Cohort Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fast Cohort's synthetic user research services (the "Service") provided by ideaX LLC ("Fast Cohort," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
Fast Cohort provides AI-powered synthetic user research services. We generate simulated user insights, market data, and customer feedback using artificial intelligence to mirror real-world patterns.
Service Details:
- Specific deliverables, turnaround times, and study parameters are described on our website at fastcohort.com and may be updated from time to time
- Current service offerings are subject to change as we improve and expand the Service
Important Limitations:
- All research participants are AI-generated simulations, not real people
- Research is based on patterns learned from training data and may not reflect current market conditions
- Like all user research, our results are directional, not definitive. Triangulation with multiple research methodologies is recommended, especially for critical decisions.
2. Account Registration and Eligibility
To use the Service, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activity under your account.
3. Intellectual Property Rights
Your Content:
- You retain all rights to the research questions, product information, and business context you provide ("Your Content")
- You grant us a limited license to use Your Content solely to generate and deliver your research study
- We will not share Your Content with third parties except as necessary to provide the Service
Research Deliverables:
- You own the research deliverables we create for you
- You may use, modify, and share the research results as you see fit
- We retain the right to use aggregated, anonymized insights from studies to improve our Service
Our Technology:
- Fast Cohort retains all rights to our platform, AI models, methodologies, and technology
- You may not reverse engineer, copy, or attempt to extract our proprietary methods
Feedback and Improvements:
- Any suggestions, feedback, improvements, or ideas you provide about Fast Cohort or the Service may be used by us without compensation, restriction, or obligation to you
- You agree that we own all rights to any improvements or modifications we make based on your feedback
4. Acceptable Use Policy
You agree to use the Service in accordance with our Acceptable Use Policy, available at fastcohort.com/acceptable-use.
In general, you agree NOT to use the Service to:
- Research illegal activities, products, or services
- Generate content that promotes hate speech, violence, or discrimination
- Attempt to identify, track, or harm real individuals
- Research topics involving minors in inappropriate contexts
- Violate any applicable laws or regulations
- Attempt to circumvent usage limits or manipulate results
- Resell or redistribute our Service without authorization
- Use the Service to compete with us or build a competing product
- Reverse engineer or attempt to extract our proprietary methods
We reserve the right to refuse or cancel any study that violates this policy. Our complete Acceptable Use Policy may include additional restrictions and is incorporated into these Terms by reference.
5. Data Ownership and Privacy
5.1 You Own Your Data
You retain full ownership of all research parameters, questions, business context, product information, and any other content you provide to us ("Your Data"). You grant us a limited, non-exclusive license to use Your Data solely for the purpose of generating and delivering your research study.
5.2 We Do Not Train on Your Data
We do not use Your Data to train, improve, or develop our AI models. Your business information, research questions, and study results remain yours. We use Your Data only to generate your specific research deliverables.
5.3 Aggregated Analytics
We may use aggregated, anonymized data derived from studies to improve our Service and understand usage patterns, provided such use:
- Does not identify you, your company, or your business
- Does not include any confidential business information or specific research parameters
- Contains no personally identifiable information
- Complies with all applicable data protection and privacy laws
5.4 What We Collect:
- Account information (name, email, payment details)
- Research parameters and questions you submit
- Product/business context you provide
- Usage data and analytics
5.5 How We Use It:
- To deliver your research studies
- To communicate with you about your studies
- To process payments
- For aggregated analytics as described in Section 7.3
5.6 Data Retention:
- We retain your study data for 12 months unless you request earlier deletion
- You can request deletion of your data by emailing team@ideax.co
- Some data may be retained longer for legal, accounting, or backup purposes

6. Disclaimers and Limitations of Liability
SERVICE PROVIDED "AS IS": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No Guarantee of Accuracy:
- We do not guarantee the accuracy, completeness, or reliability of synthetic research results
- AI-generated responses may contain errors, biases, or inconsistencies
- Research findings are exploratory and should be validated before making critical business decisions
- We make no warranties about the Service being uninterrupted, timely, secure, or error-free
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAST COHORT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any decisions made based on research results
- Any errors or inaccuracies in research deliverables
- Unauthorized access to your account or data
- Any third-party conduct or content
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC STUDY OR SERVICE PERIOD GIVING RISE TO THE CLAIM.
Time Limit for Claims: We have no liability for any claim unless you notify us in writing at team@ideax.co within 90 days of the event or circumstance giving rise to the claim.
7. Indemnification
You agree to indemnify and hold harmless Fast Cohort, ideaX LLC, and our affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any business decisions you make based on research results
8. Account Termination
Your Right to Terminate:
- You may stop using the Service and close your account at any time
- For subscription services (if applicable), cancellation terms are specified in our pricing page
- You may request deletion of your data as described in Section 7
Our Right to Terminate:
- We may suspend or terminate your account for violation of these Terms
- We may suspend access for non-payment
- We may discontinue the Service with 30 days' notice
- We may refuse service to anyone for any lawful reason
Effect of Termination: Upon termination or expiration of your account:
- Your license to use the Service immediately ends
- You must stop accessing the Service
- We may delete your data after the retention period specified in Section 7
- You remain responsible for any fees owed up to the termination date
- Sections that by their nature should survive (including IP rights, confidentiality, liability limitations, and dispute resolution) will continue to apply
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Effective Date" at the top of this document
Your continued use of the Service after changes constitutes acceptance of the updated Terms.
10. Dispute Resolution
Governing Law: These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
Informal Resolution: Before filing a claim, you agree to contact us at team@ideax.co to attempt to resolve the dispute informally.
Arbitration: If we cannot resolve the dispute informally, any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court. You waive your right to a jury trial.
Exception: Either party may seek injunctive relief in court to protect intellectual property rights.
11. Confidentiality
11.1 Confidential Information
During the Term, each party may have access to confidential information of the other party, including but not limited to:
- For you: product strategies, business plans, research parameters, competitive information, pricing strategies, customer data
- For us: platform technology, AI models, methodologies, pricing, business strategies
11.2 Obligations
Each party agrees to:
- Keep the other party's confidential information confidential
- Not disclose it to third parties without written consent
- Use it only for purposes related to these Terms
- Protect it with at least the same care used to protect its own confidential information
11.3 Exceptions
Confidential information does not include information that:
- Is or becomes publicly available through no fault of the receiving party
- Was already known to the receiving party before disclosure
- Is independently developed by the receiving party
- Is received from a third party without breach of confidentiality obligations
- Must be disclosed by law (with prior notice to the disclosing party where legally possible)
11.4 Use of Your Name
We may identify you as a customer on our website and in our customer list. However, we will not:
- Use your logo in marketing materials without your written permission
- Create case studies featuring your company without your written permission
- Represent that you endorse Fast Cohort without your written permission
12. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, and any other policies referenced on our website, constitute the entire agreement between you and Fast Cohort.
Changes to These Terms: We may update these Terms from time to time. For material changes, we will:
- Post the updated Terms on our website with a new "Effective Date"
- Notify you via email if you have an active account
- Provide at least 30 days' notice before changes take effect
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you disagree with changes, you may stop using the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
No Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.
Force Majeure: We are not liable for delays or failures due to causes beyond our reasonable control.
